Terms of Service

1. Overview

CalJin AI is an AI-powered calorie tracking and nutrition management application. The App uses artificial intelligence to analyze food images, voice descriptions, and text input, and to provide personalized meal plans based on your health profile.

2. Eligibility

You must be at least 13 years of age (16 in the EEA) to use CalJin AI. If you are under 18, review these Terms with a parent or guardian.

3. Account & User Data

• You are responsible for accuracy of onboarding data (age, weight, height, gender, activity level, goals).
• Data is primarily stored locally on your device. Uninstalling or clearing data results in permanent loss.
• You agree not to use the App for unlawful or unauthorized purposes.

4. Subscriptions & Payments

A. Free & Premium Plans

The following features require an active premium subscription:

• Manual Meal Entry — Type-based meal logging with AI analysis
• Home Screen Widgets — Live calorie, macros, and streak widgets
• Advanced AI Coaching — Personalized nutrition advice
• Unlimited AI Photo Scans — Beyond free daily limits

B. Billing

• Subscriptions billed through Google Play Store via RevenueCat.
• Plans available in 6-month and 1-year terms.
• Pricing displayed in-App, may vary by region.

C. Renewal & Cancellation

• Auto-renews unless cancelled 24 hours before renewal.
• Manage at Google Play Store → Subscriptions.

D. Refunds

Governed by the Google Play Refund Policy.

EU/UK consumers: You have the right to cancel within 14 days for a full refund under EU consumer protection law, unless you have explicitly waived this right by using premium features in that period.

E. Free Trial & Promotions

• Unused trial portions are forfeited upon subscription.
• Promotional pricing applies to first billing cycle unless stated otherwise.

5. AI-Powered Features & Health Disclaimers

C. Accuracy of AI Estimates

• AI-generated calorie and nutritional values are estimates that may not be accurate.
• AI models may misidentify foods entirely, miscount portions, or produce inaccurate macros. Review and correct AI suggestions before logging.
• Results vary by image quality, lighting, preparation, portion sizes.
• We do not guarantee accuracy of AI-generated content.

D. Voice Input

Voice audio is transmitted to Google's Gemini Live API over an encrypted connection for real-time speech recognition and analysis. Audio is not permanently stored. Voice input is optional.

6. User Conduct

You agree NOT to:

• Use the App for illegal or unauthorized purposes
• Reverse-engineer, decompile, or disassemble the App
• Interfere with App functionality or servers
• Upload harmful, offensive, or malicious content
• Share, resell, or redistribute premium subscription access
• Exploit bugs or vulnerabilities

7. User-Generated Content (Photos)

You retain ownership of food photos you capture. You grant us a limited, non-exclusive license to process those images via AI providers solely for nutritional analysis. Don't upload copyrighted material, photos of others without consent, or unlawful content. Copyright concerns: support@caljinai.com.

8. Intellectual Property

• All content, design, code, graphics, logos, and AI prompts are the intellectual property of Manolith, protected by copyright and trademark laws.
• You receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.
• No copying, modification, distribution, or derivative works without written consent.

9. Third-Party Services

Your use of these services is subject to their terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are NOT liable for indirect, incidental, special, consequential, or punitive damages.
• We are NOT liable for health outcomes from following AI suggestions.
• The App is provided "AS IS" without warranties.
• Total liability shall not exceed amounts paid in the preceding 12 months.

Some jurisdictions don't allow these limitations; in such cases liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Manolith from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the App, violation of third-party rights, or content you upload.

12. Termination

• We may suspend or terminate access at any time, with or without notice.
• Upon termination, your right to use the App ceases.
• Sections 5, 7, 8, 10, 11, and 14 survive termination.

13. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control: acts of God, natural disasters, war, civil unrest, government action, labor disputes, internet outages, third-party service failures (including AI provider outages or rate limits), or pandemics.

14. Governing Law & Dispute Resolution

A. Governing Law

Governed by the laws of India, without regard to conflict of law provisions.

B. Jurisdiction (Indian Residents)

Disputes subject to exclusive jurisdiction of courts in Salem, India.

C. Dispute Resolution (Non-Indian Residents)

Disputes first addressed via good-faith negotiation. If unresolved within 60 days, submitted to binding arbitration under International Chamber of Commerce rules, conducted remotely or in Singapore. This does not prevent you from asserting rights before a consumer protection authority in your country.

15. Severability

If any provision is held invalid by a competent court, remaining provisions continue in full force. Invalid provisions are modified to the minimum extent necessary to be enforceable while preserving intent.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CalJin AI, superseding prior agreements.

17. Changes to These Terms

We may modify these Terms. Material changes will be notified in-App. Continued use constitutes acceptance.
